The court found that Michael Friend predominantly acted as attorney when engaging Stallard Law to sever the joint tenancy, therefore privilege in those communications resided with the deceased's estate/Public Trust; the Public Trust waived privilege in respect of the challenged document(s) MJF070 and MJF071, so privilege over those documents cannot be sustained, while subsequent documents postdating severance are protected by litigation privilege and remain privileged.
