The Court granted partial summary judgment because the plaintiff proved the bulk of the indebtedness but failed to establish clearly the terms of the subsequent arrangement obliging it to make the second certified progress payment and there existed a genuine disputed question of fact whether the work in the second claim had been carried out or whether Nationwide had authority to pay it; accordingly summary judgment was entered for the loan balance excluding the second progress payment.
