The High Court concluded the District Court was entitled to find on the evidence of independent witnesses (the tow driver and a third party employee) that the Burchells' car was parked in the bay leased to Mr Cameron and that Mr Cameron authorised A2B Towing to tow the vehicle; therefore the tow and retention for towing and storage fees were lawful and the appeal failed because the Burchells did not discharge the onus of showing the decision was wrong.
