Weighing expert evidence as a whole, the court found on the balance of probabilities that the 2004 knee replacement surgery caused avascular necrosis that led to collapse of the medial tibial plateaus; this was not an ordinary consequence of treatment and therefore constituted a compensable treatment injury under s 32.

Court accepted expert diagnoses that left hip pathology is avascular necrosis attributable to the 1982 corticosteroid treatment and not caused by the 1985 fall, therefore suspension of entitlements for the left hip was justified; left shoulder was found to be post-traumatic and entitlements for the shoulder must continue.

The appellant failed to prove on the balance of probabilities that his avascular necrosis was caused by or was a consequence of the 10 February 1996 boating accident; the more persuasive expert evidence and absence of contemporaneous hip complaints meant ACC's decision to decline cover was correctly confirmed.
