The Court exercised its discretion under s 87 Judicature Act 1908 to award interest as compensatory for conversion of the appellants' property even though interest was not pleaded, and fixed overall costs to the appellants at NZD 40,000 inclusive of disbursements because appellants succeeded on conversion but achieved a substantially lesser recovery than claimed, warranting a reduced costs award.

The application was dismissed because the omission sought to be corrected amounted to a substantive variation—adding a separate element of the foreign judgment (RMB 8,567,202.23 interest)—which r 11.10 does not permit; r 11.10 is confined to correcting clerical or accidental slips and cannot be used to issue a materially different judgment than that sealed.

The Court recalled its prior judgment solely to award simple statutory interest on the $100,000 costs award from 18 May 2007 at Judicature Act rates (specified periods and rates), rejected a claim for compound interest and refused to alter the period for which interest runs or to award High Court costs or counsel fees or interest on disbursements.
