On the summary judgment record there was a real and arguable defence based on alleged oral variation of the invoice financing arrangements which could discharge or affect guarantor liability; coupled with inadequate, timely disclosure of detailed fee and charge calculations, Beneficial did not discharge the onus for summary judgment on liability or quantum, so summary judgment was dismissed.
