There was a serious question to be tried as to whether particular levies were operating expenses, and the balance of convenience favored preserving the plaintiffs' berths pending final determination because the plaintiffs' loss of berths would be irremediable while TBML's loss was financial and compensable by damages; accordingly an interim injunction restraining TBML from transferring or selling the plaintiffs' berth licences pending final determination was granted.
