    Leave to appeal was refused because the issues identified were not capable of bona fide and serious argument on the facts: the parties' occupation rights arose as discretionary beneficiaries of a trust (not as spouses), the Family Court did not have a viable basis to reopen the Westpac mortgage and Westpac was not a party, and allegations of bias/hearing rule breaches were unsupported; extension of time to file was granted but leave on the occupation order and Credit Contracts Act issues was dismissed.
