The Court remitted the matter to the Real Estate Agents Disciplinary Tribunal to consider the impact of Mrs West's testimony and the fresh evidence; the Court declined to determine the disciplinary charges itself and declined to stay remittal pending the Court of Appeal (leaving any stay to the Tribunal); costs of the High Court proceedings were ordered to lie where they fall; the parties were directed to agree reasonable disbursements specific to the High Court appeal with leave to return to the Court if they cannot agree.
