Because the defendant's affidavit disclosed the scope and steps taken to locate documents and the bank had been queried, the court ordered the defendant (through Mr Ma) to file a further affidavit of documents complying with r 8.15(2) addressing each specified category, to list bank statements if received or record the request and any bank refusal, and to provide any obtained bank statements as a full set; this was the necessary and proportionate remedy to resolve the discovery dispute.
