The Supreme Court granted leave to appeal because the question whether the High Court was correct to dismiss the appeal against the Board of Inquiry raised arguable legal errors and matters of sufficient public and legal importance to warrant appellate determination.

The appeals were genuine public interest challenges and the appellants acted reasonably; accordingly under High Court Rules r 14.7(e) the Court exercised its discretion to refuse an award of costs and ordered that costs lie where they fall.

The High Court held the Board acted within law and discretion: its factual conclusion that the WLR designation was not a viable, credible alternative and could not co-exist with the Expressway justified excluding the WLR from the environment and the permitted baseline; the Board had regard to the Minister's reasons; no legal error was shown and the appeal was dismissed.
