Leave to appeal was dismissed because the appeal had no realistic prospects of success and there was no appearance of miscarriage of justice; the Court endorsed the Court of Appeal's approach that 'totally without merit' means 'bound to fail' and held that the court considering an extended order need not rehear candidate proceedings afresh.
