S 83(2) does not prevent cumulative sentences where the defendant absconded from a home detention sentence and was not 'no longer detained' in the statutory sense; pre-sentence detention cannot be used to manipulate sentencing per s 82; cumulative sentences for escape/absconding and subsequent offending are appropriate; given the seriousness of the offending the total sentence of 28 months is not manifestly excessive, so the District Court sentence is affirmed.
