- High Court
Given the existence of a Court‑sanctioned scheme that requires expeditious remediation, imminent risk of irrevocable termination of a construction contract, the Body Corporate's apparent refusal or inability to perform core contractual and scheme obligations (principal's bond, levies, possession, engineer appointment), and the urgency and risk of misrepresentation to owners, the Court was justified in appointing an interim administrator (Anthony McCullagh) with powers to act to preserve the scheme and perform the contract obligations pending further directions.
