The application for ancillary discovery/orders was dismissed: although the plaintiff established a good arguable case, there was insufficient evidence of a danger that assets would be disposed of or diminished in a way that would risk satisfaction of a prospective judgment beyond ordinary course commercial decisions and established write-offs; therefore ancillary freezing-related discovery was not just and necessary under r 32.5.
