By a narrow margin the applicant demonstrated a seriously arguable breach, a real risk that the defendants would dissipate or improperly deal with Portfolio's assets, the balance of convenience favoured preserving the status quo, and an undertaking as to damages was provided; accordingly without-notice interim relief was justified.
