The Environment Court erred as a matter of law by placing excessive weight on limited 2013 oral evidence of Mr S Rolleston and drawing adverse findings of a change in Pirirakau's position that were not reasonably open on the total evidence from the 2009 hearing and prior decisions; that error materially affected the outcome, so the High Court set aside the grant of consent and remitted the matter to the Environment Court.
