Because the statute requires paid employment for 'employment' and the applicant's activities were unpaid voluntary activism and on the facts he was not seeking, available, willing and able to undertake paid full-time employment, the Ministry lawfully cancelled the unemployment benefit.

Balancing the three medical opinions and the factual matrix (no prior back problems, continuous symptoms from time of 1993 injury, Dr Doube's clinical examination and opinion), the Court found on the balance of probabilities that the appellant's ongoing back problems are attributable to the 1993 injury; therefore the respondent's decision cancelling cover was wrong and is revoked.

On the evidence available at the relevant time (including Dr Heynen's targeted examination) the review officer was entitled to rely on the specialist medical opinion and to uphold cancellation when the appellant declined re-examination, and Dr Perry's report did not address capacity to perform the specified household tasks and thus did not undermine Heynen's conclusion, so the cancellation was valid.
