On the balance of probabilities the evidence established that the 1992 accident continued to cause symptoms and incapacity which were then exacerbated by later events and surgery; ACC did not possess a sufficient evidential basis to suspend entitlements under s117 as at June 2015, therefore the suspension decision could not be sustained and must be quashed.
