Indemnity costs were not warranted: the case was not an exceptional or hopeless one and failure to join the Council or an adverse credibility finding did not justify indemnity costs. However, Blueskin rejected Calderbank offers without reasonable justification assessed at the time the offers were made, warranting increased costs. Accordingly Blueskin was ordered to pay costs on scale category 2B with a 25% uplift on scale costs for all steps taken after 16 May 2012 together with usual disbursements and witness expenses.
