Judge found on the evidence, including contemporaneous and specialist medical material and consideration of the nature of the employment trial, that the appellant remained presently incapacitated from undertaking his pre-accident employment under s103(2); the short duration and nature of the consultancy role, the specialist opinions and medical certificates supported incapacity and the trial employment did not break the causal connection between injury and loss of capacity.
