Leave to appeal out of time was granted because the interests of justice favored review; the conviction was quashed because the trial judge's question trail failed to require proof of the defendant's state of knowledge at the time losses were caused and introduced irrelevant post-offending matters, and the Crown declined to seek a retrial because reparation was paid and the sentence effectively served.

Conviction appeal dismissed because appellant failed to demonstrate exceptional circumstances or a miscarriage of justice arising from guilty pleas; sentence appeal dismissed because the starting point, uplift and discounts were appropriate and the end sentence was not manifestly excessive, save that 21 August 2020 to 29 September 2020 must be deducted from the community detention sentence because monitoring improperly continued during the appeal.

Although this Court erred in overlooking the statutory one‑third non‑parole period for the 18 month sentence (affecting the non‑parole percentage), the error was not a fundamental error of process nor did it cause a substantial miscarriage of justice; the offending and appropriate denunciation/deterrence meant the correct non‑parole calculation would still have been within range, and subsequent Parole Board refusals demonstrate no practical prejudice; accordingly leave for a second appeal is refused.
