On balance of probabilities the Court found contemporaneous medical and independent lay evidence established testamentary capacity, the solicitor's explained reading and discussion of the draft dispelled suspicion and showed knowledge and approval, and there was insufficient evidence to infer undue influence by the beneficiary; probate of the 14 March 2006 will granted.
