Because there was no person able to oppose the relief (the caveat had been withdrawn and no defendant or other party opposed) and the Associate Judge's review supported the relief, the Court had authority to and did enter judgment in terms of paragraphs (a) and (b) of the plaintiffs' statement of claim.

Because the respondent withdrew the caveat the applicant's position was equivalent to succeeding at a contested hearing, giving a presumptive entitlement to costs; there were no exceptional circumstances to justify indemnity costs, so costs were awarded on a 2B basis.
