The plaintiffs' tactical decision to change their expert after participating in the joint experts' report rendered the joint experts' process redundant and wasted the direct costs incurred by Southern Response in that process; accordingly the plaintiffs were ordered to reimburse Southern Response for quantified wasted costs and the defendants were awarded costs on the application.
