Leave to appeal and leave to bring judicial review were declined: the court held s245 allows judicial discretion in the interests of justice and s249 must be applied consistently with the Bill of Rights, and although the interests of citizen children can be relevant to refugee/protected status decisions in rare circumstances, they were not relevant on these facts and the applicants' arguments were not capable of bona fide serious argument.
