Given the size, complexity and predominant reliance on expert evidence, the judge exercised rule 9.46 and case management powers under the High Court Rules to order grouping of expert evidence into specified topic groups because grouping would assist the Court, was permitted by the rules, did not cause irremediable prejudice, and preserved parties' ability to control the order of their witnesses within groups, with sequencing of groups to be agreed by counsel or returned to the Court if necessary.
