The court found there was a serious issue to be tried because evidence indicated PIC Avondale had a beneficial interest through longstanding contributions and relevant trust documentation; the balance of convenience favored the applicants given their long habit of worship, size (about 306 members) and lack of practical alternatives; applicants gave an undertaking as to damages; accordingly interim relief was granted in the terms sought.
