The Court ordered immediate sale and equal division of net proceeds because, applying s 342, the applicant's entitlement to realise her long‑denied half-share and the refusal of the defendant to purchase or cooperate meant the hardship to the applicant from refusal of sale outweighed the hardship to the defendant; incidental orders were necessary to effect sale where the defendant refused to cooperate.
