CAYMAN SPECTRUM (NZ) CO v SPARK NEW ZEALAND TRADING LTD [2023] NZHC 1094

- High Court
Leave to use discovered documents for collateral purposes was declined: applicants lacked a legitimate interest separate from Blue Reach, the proposed use was unconnected to the proceeding, Blue Reach obtained access opportunistically, the documents when read with Spark's filings did not disclose prima facie criminality or dishonesty sufficient to justify overriding the discovery undertaking, disclosure would prejudice Spark and its staff, and regulatory bodies already possess investigatory powers rendering the court exercise of discretion inappropriate.
