The Court found the injunction unambiguous as to prohibiting both operation and placement of irrigation equipment on the covenanted land and prohibiting fertiliser application; defendants allowed irrigators to track over Blocks A and B (with overspray on specified dates) and permitted fertiliser to be spread on Block B without appropriate precautions, and those acts constituted contempts established beyond reasonable doubt in respect of tracking/overspray and fertiliser spread; by contrast continued use of an existing gravel access track did not constitute contempt of the interim injunction.…
