Because the Body Corporate lacked a functioning governance structure (no committee or effective AGM since 2014), there was ongoing dysfunction preventing urgent building works, and there was imminent risk of further property damage and interference with tenants and funds, the Court exercised its s141 discretion to appoint an independent interim administrator (Paul Crew) with authority to access and operate the Body Corporate bank account and to investigate and report to the Court pending a full hearing.
