Having found deliberate breaches of interim injunctions, the Court accepted the contempt was purged by remedial steps and, balancing seriousness, culpability, means and deterrence, imposed a total fine of NZD 5,000 jointly and severally on Netherland Holdings Limited and the Wobben defendants, directed 90% of the fine to the Trust and 10% to the Crown, and awarded the Trust indemnity costs for the contempt proceedings; community service was declined as unnecessary given the purge and the fine imposed.
