The District Court judge correctly applied the s106 three-step test, reasonably assessed the offending as moderately serious coupled with absence of remorse, found no exceptional or disproportionate adverse consequences from conviction, and therefore was correct to refuse a discharge without conviction; the Court of Appeal dismissed the appeal.
