The Court held the Judge was entitled to infer an intention to cause serious harm from the unprovoked, forceful, directed punch to the head with premeditation and aggravating post-offence conduct, so Taueki applied and a five-year starting point was available; the discounts (20% guilty plea, 10% youth, 10% cultural/social) were within available discretion given the offender's history and seriousness of the offence; the three-year imprisonment term was not manifestly excessive and the appeal was dismissed.
