The High Court dismissed the appeal and the application for further evidence: the Family Court correctly exercised its discretion to award costs to the overall successful party on a 2B scale (subject to specified deductions), to require the unsuccessful party to meet travel costs consequent on transfer, and to refuse indemnity for PLB Trustees' claimed costs where evidence of those costs was inadequate; the proposed additional evidence was not fresh or cogent and could have been produced earlier, so it was rightly excluded.

The High Court upheld the Family Court's factual finding that the parties were in a de facto relationship and that the appellant had disposed of relationship property into TTL with the intention of defeating the respondent's claim such that s44 applied; accordingly the Family Court's order transferring 19B Cathedral Place so it could be treated as relationship property, and the compensatory orders under s20E and for occupation rent, were within jurisdiction and were confirmed on appeal.
