Leave to bring a second appeal was refused because the proposed appeal advanced alleged factual errors, which are outside the scope of second appeals under s 60 and Waller v Hider, the appellant has not demonstrated he can fairly and competently act as litigation guardian and has interests adverse to his daughter, and the proposed appeal does not raise issues of public or private importance sufficient to justify further appeal to the Court of Appeal.
