An ancillary mandatory monitoring order was justified and granted in limited form because there was a real risk that non-compliance with consent interim restraining orders would not be observable without monitoring; that risk combined with the inadequacy of damages in IP cases justified monitoring subject to safeguards (independent monitor, general joint instruction, random checks, screenshots only on non-compliance with pricing redacted, cost borne by applicant).
