The Reviewer erred by applying s56; because s36(2) deemed the mental injury date to be the date of the physical injury the claim was lodged outside the 12 month limit and constituted a complicated claim under s57, the Corporation complied with the procedural steps and made its decision within the nine month limit in s57(4), therefore no deemed decision arose and the review decision is quashed.
