Leave to adduce the affidavit of Malcolm Lyall was refused because the evidence was not fresh (it could with reasonable diligence have been obtained for the Panel), it primarily bolstered existing evidence rather than raised matters arising after the decision, it was not sufficiently cogent to materially assist the Court on appeal, and the appellants failed to demonstrate the special reasons required by r 20.16.
