On the pleaded facts and undisputed evidence the BIA did not owe a reasonably arguable common law or statutory duty to investigate certifiers nor a tenable duty to notify the Council of changes to a certifier's scope; negligent misstatement claim failed because the BIA's communications were heavily qualified and disclaimed binding responsibility; consequentially the third party notice and all four causes of action against the BIA were struck out.
