The plaintiffs established entitlement to costs of $60,411 against Cameron Slater because judgment was entered by consent, no other defendants had paid or agreed to pay costs for the claimed steps (so no duplication), and the plaintiffs did not seek uplift given Slater's bankruptcy; consequently the Court awarded costs and ordered the settlement agreement sealed, rendering a suppression order unnecessary.

Because the parties reached and recorded a full and final settlement at the conference, the Court entered a consent judgment for the plaintiff in respect of the specified defamatory publications, recorded the defendant's retraction and apology and noted payment of a confidential settlement; other claims were dismissed and no order as to costs was made.

Although the Tribunal's comparative rationale distinguishing disciplinary hearings from criminal trials contained errors, the ultimate decision to refuse alternative mode was not wrong on the facts: given the nature and context of the alleged conduct, the respondent's admissions, the confidential settlements, lack of ongoing relationship or authority, absence of evidence the witness would be disbelieved, and the need to balance fairness to both parties, the witness should give evidence in the ordinary way.
