The Court of Appeal concluded the notice of appeal should be accepted for filing because the matter did not clearly fall within the statutory definition of an interlocutory application requiring leave and any jurisdictional issue can be determined at a hearing; accordingly the Registrar's decision was reviewed and set aside.
