Applicant failed to prove on the balance of probabilities that the deceased had testamentary capacity on 30 December 2017 or 3 January 2018 and failed to prove the unsigned document recorded an immediate and unconditional testamentary intention; accordingly the High Court was correct to refuse a s 14 declaration and the Court of Appeal dismissed the appeal.
