Because the Auckland and Christchurch proceedings were inter-related and the summary judgment proceeding had largely achieved its purpose by repayment of the debt, the judge could, under High Court Rules r 425(a), treat the proceedings as one for the purpose of interlocutory directions; accordingly the Auckland file was to be temporarily transferred to Christchurch and a single hearing set to determine the strike-out and consolidation/transfer applications.
