Applicant's contempt application lacked merit because s 16 contempt proceedings are a last resort and the applicant had not attempted available alternative enforcement mechanisms; indemnity costs were not justified because the applicant did not act vexatiously or very unreasonably; increased costs were warranted because the applicant unnecessarily contributed to the expense of the proceeding by bringing an inappropriate contempt application; a 20% uplift on 2B scale costs was appropriate.
