The application for summary judgment could not proceed to recover the billed amount while s 161 applied, but the Court retained jurisdiction to determine the liability question of whether the contingency fee agreement was illegal under s 66; accordingly the appeal was allowed in part, the District Court proceeding was transferred to the High Court for determination of liability and directions were given.
