There was a genuine and substantial dispute about the net indebtedness because the applicant had an arguable equitable set-off supported by the contract terms and pre-contractual emails demonstrating that the quoted amounts were estimates and could be exceeded; accordingly the statutory demand was set aside and costs awarded to the respondent on a 2B basis.
