The Court found there is a serious issue to be tried that the Turbine's internal design and servicing information may be confidential and that contractual provisions in the Plant Agreement and LTMA provide an arguable basis for an obligation of confidence; on balance of convenience, because damages would not adequately protect Siemens against disclosure to a competitor, an interim injunction preserving the status quo was granted to prevent transfer/disclosure subject to conditions (security, arrangements for removal, prompt further steps).
