Because Jagose J's minute appointing the Law Society as contradictor expressly referred to Shand, the applicant was entitled to assume he faced no risk of a costs award; it would be improper in those circumstances to award costs against him, so the appropriate remedy is to recall the judgment and delete the paragraph awarding costs.
